Terms and Conditions of Service – mr.beni

This document constitutes a legally binding agreement between you (“user”) and mr.beni (“we”, “us”, “our”).

By accessing, using the site, or making a purchase, you agree to these Terms in full. If you do not agree, you must refrain from using the site.

  1. Nature of the Service

mr.beni offers personalized products based on materials provided by the user, including images.

The service is creative and interpretative in nature, not replicative.

We reserve the right to modify, reject, limit, or cancel any order or service at our sole discretion.

  1. Use of the Site

You agree to:

  • Provide accurate, complete, and up-to-date information

  • Not use false identities or act in bad faith

  • Not infringe third-party rights

  • Not upload illegal, protected, or unauthorized content

Violation may result in immediate cancellation of orders or access, without obligation of compensation.

  1. Order Processing

Orders enter processing only after:

  • Payment confirmation

  • Design approval (when applicable)

  1. User Content and Responsibility

By uploading images or content:

  • You represent and warrant that you have all necessary rights

  • You assume full legal responsibility for such content

  • mr.beni does not verify or validate ownership rights

mr.beni shall not be liable for any claims arising from user-provided content.

  1. Design Approval (CLAUSE)

Before production, you may receive a preview of the design.

By approving the design:

  • You confirm that the result meets your expectations

  • You waive any future claims related to the design

  • You accept that no modifications, refunds, or rework will be provided

Failure to respond within ten (10) calendar days may be considered automatic approval.

  1. Nature of the Result

You acknowledge and agree that:

Each illustration is created based on the photograph you provide.

  • The result is an artistic interpretation, not an exact copy

  • The final outcome is directly influenced by the quality, lighting, and angle of the image provided

  • Expressions, poses, or complex elements not visible in the original image will not be modified

  • All illustrations are created as mid-body compositions (chest, neck, and head), unless otherwise specified before the service

  • A digital preview will be provided before production for approval

  • Once approved, no further changes will be made

  • Variations in color, proportions, details, and style may occur

  • Digital screens may not accurately represent the final product

We recommend submitting clear images with good lighting and no filters.

Claims based on subjective opinions (e.g., “I don’t like it”, “this is not what I expected”, among others) will not be accepted. You may find more information in the Refunds Policy.

  1. Timing and Duration at Each Stage

Processing, creation, and production times:

  • Are estimates

  • Are not guaranteed

  • May vary depending on current demand, design complexity, and external factors

Production time is separate from shipping time. We reserve the right to extend timelines at any stage during periods of high demand.

  1. Modifications and Cancellations

Once the order is confirmed:

  • It cannot be canceled or modified

  • Any adjustments will be evaluated solely at our discretion

  • Additional charges may apply

Design and approval stage:

  • Any modification must be requested before design approval and must be limited strictly to minor adjustments based on the originally provided image

We reserve the right to reject changes at any stage.

Failure to respond within sixty (60) calendar days may be considered cancellation by the client. After this period, we are exempt from refunds, claims, or legal processes. You may find more information in the Refunds Policy.

  1. Production and Third Parties

mr.beni acts as a design provider.

Physical production (printing, materials, shipping) is carried out by third parties.

The user acknowledges that:

  • We do not fully control these processes

  • We do not guarantee identical results between units

  • We do not assume direct liability for third-party failures

We may assist with claims at our discretion, without obligation.

  1. Pricing and Payments

  • Prices may change at any time

  • Full payment must be completed before starting the order

  • You guarantee that you are authorized to use the selected payment method

We reserve the right to cancel orders due to errors, fraud, or suspected misuse.

  1. Shipping and Risk

  • Delivery times are estimates and not guaranteed

  • The carrier is a third-party service

  • Risk transfers to the customer once the product is handed to the carrier

  • We are not responsible for delays, losses, or damages in transit

  • We are not responsible for the information provided by the customer for shipping purposes

If the carrier confirms delivery, the order is considered fulfilled.

  1. Returns and Refunds

Due to the personalized nature:

  • Returns for change of mind are not accepted

  • Subjective claims are not accepted

Refunds apply only if:

  • The order has not been started (100%)

  • The design has not been printed on the product (partial refund, at our discretion)

No refunds will be issued once production has started.

All requests will be evaluated at our sole discretion.

  1. Use of Content

mr.beni may use any created design for promotional, commercial, or advertising purposes.

Clients may request exclusion in advance, without guarantee of acceptance.

  1. Third-Party Services

We are not responsible for:

  • Third-party products or services

  • Failures in production, shipping, or logistics

  • External content

Use of such services is at your own risk.

  1. Limitation of Liability

The service is provided “as is” and “as available”.

To the maximum extent permitted by law:

  • We do not guarantee specific results

  • We do not guarantee error-free operation

  • We do not guarantee customer satisfaction

mr.beni shall not be liable for indirect, incidental, emotional, or consequential damages.

  1. Indemnification

You agree to indemnify and hold mr.beni harmless from any claims arising from:

  • Use of the site

  • Content provided

  • Breach of these Terms

  1. Termination

We may suspend or terminate your access at any time, without prior notice.

Outstanding obligations will survive termination.

  1. Dispute Resolution

This agreement is governed by the laws of the United States.

All disputes shall be resolved through binding arbitration.

You expressly waive:

  • The right to a jury trial

  • The right to participate in class actions

  1. General Provisions

  • Failure to enforce any provision does not constitute a waiver

  • If any provision is invalid, the remainder remains enforceable

  • This agreement constitutes the entire agreement between the parties
